These Terms of Service ("Terms") govern your access to and use of the website stacketechnologies.com and any related services, products, and applications operated by Stacke Technologies Inc ("Stacke", "we", "us", "our"), a corporation organized under the laws of the State of Wyoming, USA.

By accessing or using our services, you agree to be bound by these Terms. If you do not agree, do not use our services.

1. Eligibility

You must be at least 13 years of age to use our services. If you are under 18, you must have permission from a parent or legal guardian. By using our services, you represent that you meet these eligibility requirements.

2. Acceptable use

You agree not to use our website or services to:

  • Violate any applicable law or regulation;
  • Infringe the intellectual property rights of Stacke or any third party;
  • Transmit malware, viruses, or any harmful code;
  • Attempt to gain unauthorized access to any portion of our systems;
  • Engage in automated scraping, harvesting, or data mining without our express written consent;
  • Impersonate any person or entity, or misrepresent your affiliation with us;
  • Use our services to harass, defame, or harm any individual or group.

3. Intellectual property

All content on this website and across our content network — including but not limited to videos, articles, designs, logos, source code, and the brand identities of our channels and applications — is owned by Stacke Technologies Inc or its licensors, and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any of our content for commercial purposes without our prior written permission.

4. Beta programs

Some of our products — including the NOVELS app — may be offered to users as part of a closed or open beta program. You acknowledge that beta features:

  • Are provided on an "as-is" basis and may contain bugs or unexpected behavior;
  • May be modified, suspended, or discontinued at any time without notice;
  • Are confidential until publicly released; you agree not to share screenshots, recordings, or details about beta features without our consent;
  • Do not constitute a final product, and final functionality, pricing, and availability may differ from the beta version.

5. Subscriptions and payments

At the time of writing, Stacke does not offer paid subscriptions to consumers. When paid services become available, additional terms — including pricing, billing cycles, and refund eligibility (see our Refund Policy) — will apply and will be presented at the point of purchase.

6. Third-party services

Our website and applications may rely on third-party services (e.g., Cloudflare for hosting and email routing, Stripe for payment processing when applicable, YouTube and TikTok for our content network). Your use of those services is also subject to the third party's own terms and privacy policies.

7. Disclaimers

No guarantees of outcomes. Our content, products, and applications are provided for entertainment and informational purposes. We make no representations or warranties about specific results, financial returns, or other outcomes you may achieve through the use of our services.

"As-is" and "as available". Our services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Stacke disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of liability

To the fullest extent permitted by applicable law, Stacke Technologies Inc, its directors, officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of our services.

In no event will our aggregate liability exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (USD 100).

9. Indemnification

You agree to indemnify and hold harmless Stacke and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms or your misuse of our services.

10. Termination

We may suspend or terminate your access to our services at any time, with or without notice, if we believe you have violated these Terms or applicable law. Upon termination, the provisions that by their nature should survive — including intellectual property, disclaimers, limitation of liability, and governing law — will continue to apply.

11. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, USA, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or our services will be resolved in the state or federal courts located in Wyoming, and you consent to the personal jurisdiction of those courts.

12. Changes to these Terms

We may revise these Terms from time to time. The "Last updated" date at the top of this page indicates when the Terms were last revised. Material changes will be communicated via the website. Your continued use of our services after the changes take effect constitutes acceptance of the updated Terms.
